Agreement to Terms
These Terms of Service (“Terms”) govern your use of the Gitback Reviews platform operated by Gitback Reviews (“Gitback,” “we,” “us,” or “our”) at gitbackreviews.com. By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the platform.
Description of Service
Gitback Reviews is a client retention and review management platform for small service businesses. The platform enables you to send automated review requests to clients via SMS and email, collect satisfaction ratings and private feedback, capture decline reasons from missed clients, run automated win-back communication sequences, monitor Google reviews, display reviews on your website via an embeddable widget, and view retention analytics on a dashboard. The platform sends messages to your clients on your behalf using third-party communication providers (Twilio for SMS, SendGrid for email).
Account Registration
To use Gitback Reviews, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access to your account. You must be at least 18 years of age to create an account.
Subscription and Payment
Once Gitback Reviews exits the beta period, the platform will be offered as a monthly subscription. The current subscription price and included features will be listed on our pricing page at gitbackreviews.com/pricing. Payment will be processed by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis. You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods. We reserve the right to change subscription pricing with 30 days’ notice. Price changes do not apply to the current billing period.
Acceptable Use
You agree to use Gitback Reviews only for lawful purposes and in accordance with these Terms. Specifically, you agree that you will only send messages to individuals with whom you have an existing business or service relationship, you will not use the platform to send unsolicited bulk messages or spam, you will comply with all applicable laws and regulations regarding electronic communications including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state laws, you will not upload or transmit false, misleading, or fraudulent information, you will not attempt to circumvent message opt-out mechanisms, and you will not use the platform to harass, threaten, or harm any individual.
Client Communications and Consent
By using Gitback Reviews to send messages to your clients, you represent and warrant that you have an existing business relationship with each recipient, you have obtained any required consent to send electronic communications to each recipient, you will honor all opt-out requests promptly, and you will comply with all applicable telecommunications and electronic messaging laws. You are solely responsible for ensuring compliance with applicable laws regarding the messages sent through the platform. Gitback Reviews provides the tools and infrastructure but does not independently verify consent for individual recipients.
Intellectual Property
The Gitback Reviews platform, including its software, design, logos, documentation, and content, is owned by Gitback Reviews and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your business purposes during the term of your subscription. You may not copy, modify, distribute, sell, or reverse-engineer any part of the platform.
Data Ownership
You retain ownership of all data you upload or create on the platform, including client contact information, campaign data, and business information. We do not sell your data to third parties. Our use of your data is governed by our Privacy Policy. Upon account termination, you may request an export of your data within 30 days.
Embeddable Review Widget
Gitback Reviews provides an embeddable JavaScript widget that displays Google reviews on your website. By using the widget, you agree that review data displayed is sourced from publicly available Google reviews, the widget is provided “as is” and may be affected by changes to third-party review platforms, and you are responsible for the placement and display of the widget on your website.
Service Availability
We strive to maintain high availability of the platform but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to scheduled maintenance (we will provide advance notice when possible), unscheduled maintenance or emergency repairs, or factors outside our control including third-party service outages, network issues, or force majeure events. We are not liable for any damages resulting from service interruptions.
Limitation of Liability
To the maximum extent permitted by applicable law, Gitback Reviews shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, arising out of or in connection with your use of the platform. Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Gitback Reviews and its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or related to your use of the platform, your violation of these Terms, your violation of any applicable law or regulation, the messages you send through the platform, or any dispute between you and your clients.
Termination
We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, use the platform in a manner that could harm other users or our infrastructure, or are required to do so by law. You may terminate your account at any time by canceling your subscription and contacting us at support@gitbackreviews.com.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last Updated” date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California.
